1. Acceptance of Terms
By tapping "I Agree," creating an alarm, or otherwise using Zonal ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and the developer. If you do not agree to these Terms, do not use the App and uninstall it from your device. A current copy of these Terms is always available at zonal.dev/terms.
2. Description of Service
Zonal is a general-purpose clock, time zone, and alarm utility for Android. The App allows users to set alarms, manage time zones, and configure notifications for personal use. Zonal is not a medical device, is not FDA-cleared or approved, and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The App is not designed or intended for use in any safety-critical, health-critical, or life-critical context.
3. Not a Medical or Safety Device
Nothing in the App constitutes medical advice, and the App is not a substitute for professional medical advice, diagnosis, or treatment. Although the App's alarms may be useful for a variety of personal reminders, the App is a general-purpose utility and is not designed or intended for use as a primary means of managing health-related, safety-critical, or time-sensitive obligations.
By using the App, you expressly acknowledge and agree that: (a) the App is not designed, intended, or suitable for use as a primary or sole reminder system for any health-related, safety-critical, or time-sensitive purpose; (b) you will maintain independent methods of managing any important schedules or obligations; (c) you will always follow the guidance of qualified professionals regarding health or safety matters; and (d) any reliance on the App for important reminders is at your sole risk.
4. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement.
The developer does not warrant that:
- The App will function uninterrupted, securely, or error-free.
- Alarms or notifications will be delivered reliably under all circumstances.
- The App will be compatible with all devices, operating system versions, or device configurations.
You acknowledge that alarm delivery may be affected by factors outside the developer's control, including but not limited to: Android battery optimization and Doze mode, manufacturer-specific power management settings, device restart or shutdown, low battery or power-saving modes, Do Not Disturb settings, operating system updates, and other system-level behaviors.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the App, regardless of the legal theory (whether contract, tort, negligence, strict liability, or otherwise) and even if the developer has been advised of the possibility of such damages.
This includes, without limitation, any damages arising from missed, delayed, or failed alarms or notifications, or any health-related, safety-related, or other consequences allegedly resulting from the use of or reliance on the App.
In no event shall the developer's total liability to you for all claims arising out of or relating to the App, whether in contract, tort (including negligence), strict liability, or any other legal theory, exceed the amount you actually paid to the developer for the App in the twelve (12) months preceding the event giving rise to the claim, or ten dollars ($10.00), whichever is greater.
Any claim arising out of or relating to these Terms or the App must be brought within one (1) year after the cause of action arises, or it is permanently barred. This limitation applies regardless of whether the claim is based on contract, tort, strict liability, or any other legal theory.
6. Assumption of Risk
You assume full responsibility for your use of the App. You acknowledge that you should not rely solely on the App for critical or important reminders, and that maintaining independent methods of tracking important events, obligations, and schedules is your responsibility.
Without limiting the generality of the foregoing, you expressly assume all risks associated with: (a) missed, delayed, silent, or inaudible alarms or notifications; (b) any consequences arising from missed or delayed reminders, including but not limited to health-related, financial, or professional consequences; (c) use of the App in any safety-critical, health-critical, or time-sensitive context; and (d) any failure of the App caused by device settings, operating system behavior, or other factors outside the developer's control.
7. Privacy
Zonal does not collect, transmit, or store any personal data. All alarm data and settings are stored locally on your device. The App does not require an internet connection to function, and no information is sent to external servers. For full details, see our Privacy Policy.
8. Third-Party Services
The App may rely on Android system services (such as the AlarmManager API) for alarm delivery. The developer is not responsible for the behavior, availability, or reliability of third-party services or the Android operating system.
9. Changes to Terms
The developer reserves the right to modify these Terms. If material changes are made, the developer will provide at least thirty (30) days' advance notice by posting the updated Terms within the App and on the App's store listing. The notice will indicate the date the revised Terms take effect. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App before the effective date. Non-material changes (such as typographical corrections or formatting updates) may take effect immediately.
10. Dispute Resolution and Arbitration
Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your use of the App ("Dispute") shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. Arbitration shall take place in the State of Wyoming, or at another mutually agreed location. The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this Section.
Class Action Waiver
You and the developer agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Waiver of Jury Trial
By agreeing to these Terms, you and the developer each waive the right to a trial by jury.
Costs
The developer will pay all arbitration filing fees and arbitrator costs for claims under $10,000, unless the arbitrator finds the claim is frivolous. Each party shall bear its own attorneys' fees unless the arbitrator awards them to the prevailing party.
Opt-Out
You may opt out of this arbitration provision by sending written notice to dev@zonal.dev within thirty (30) days of first agreeing to these Terms. If you opt out, the remaining provisions of these Terms will continue to apply.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction and venue therein.
12. Age Requirement
The App is intended for users who are at least thirteen (13) years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The developer does not knowingly provide the App to children under 13. If the developer learns that a child under 13 is using the App without parental consent, the developer reserves the right to take appropriate action, including terminating access.
13. Intellectual Property
The App and all related content, features, functionality, design, and source code are owned by the developer and are protected by copyright, trademark, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or disassemble the App, in whole or in part, except to the extent expressly permitted by applicable law.
14. Indemnification
You agree to indemnify, defend, and hold harmless the developer and its affiliates, officers, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or reliance on the App; (b) your use of the App for any health-related, safety-critical, or time-sensitive purpose; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.
15. Termination
The developer may terminate or suspend your license to use the App at any time, without prior notice, for any reason, including if you violate these Terms. Upon termination, your right to use the App ceases immediately, and you must uninstall the App from your device. Sections 3 through 6 (Not a Medical or Safety Device, Disclaimer of Warranties, Limitation of Liability, and Assumption of Risk), Section 10 (Dispute Resolution and Arbitration), Section 11 (Governing Law), Section 13 (Intellectual Property), Section 14 (Indemnification), and this Section 15 shall survive any termination of these Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and the developer regarding the App and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral, regarding the App.
